1. Scope
1.1 These General Terms and Conditions apply to all rental agreements between A. Soloveychik & E. Fuhrer GbR (hereinafter “landlord”) and the tenant for the rental properties shown on the landlord’s website.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for private purposes. An entrepreneur is any natural or legal person who concludes a legal transaction in the exercise of their professional activity.
2. Conclusion of contract
2.1 The presentation of the rental properties on the website is non-binding. The tenant makes a binding offer by completing the booking.
2.2 The contract is concluded if the landlord accepts the offer within five days, e.g. B. by confirmation by email or request for payment.
2.3 Reservations within the guest’s place of residence are only possible with the landlord’s express consent.
3. Right of withdrawal for consumers
There is no right of withdrawal for accommodation contracts if the contract is concluded for a specific period of time (Section 312g Para. 2 No. 9 BGB).
4. Rental property
4.1 The rental property includes the premises and furnishings described in the contract.
4.2 The rental property is only to be used for the agreed purpose and the agreed number of people.
5. Arrival and departure times, key collection
5.1 Check-in is possible from 4:00 p.m., check-out must be carried out by 10:00 a.m. Different times can be arranged upon request.
5.2 Guests who exceed the check-out time or obstruct the cleaning staff are liable for the resulting costs.
5.3 Guests are liable for the cost of replacing lost keys, key cards, key fobs or parking permits.
6. Rent and payment terms
6.1 The rent must be paid in advance unless otherwise agreed.
6.2 Additional costs such as electricity, water and WiFi are included in the rental price.
7. Use of the rental property
7.1 Overnight guests who exceed the number stated in the booking are not permitted.
7.2 Pets are not allowed. Violations of the pet policy may result in a fine. Guests with service animals must inform the landlord in advance.
8. Behavior in the rental property
8.1 Smoking, parties and excessive noise are not permitted in the rental property. Violations of the smoking ban will result in a fine of €300, in addition to the costs of cleaning, deodorizing and repairing any damage.
8.2 Commercial photography or videography without the written consent of the landlord as well as illegal activities are strictly prohibited.
9. Use of the rental property
9.1 The Landlord reserves the right to use noise detection technologies to monitor excessive noise levels.
9.2 Guests assume full responsibility for any damage, injury or loss that occurs on the premises or in the facilities. Guests must report property damage to the landlord immediately.
10. The landlord’s obligation to maintain the property, the tenant’s rights in the event of defects
10.1 The landlord keeps the rental property in a contractual condition.
10.2 The tenant is obliged to report defects immediately.
11. Contractual right of withdrawal
11.1 The tenant can cancel free of charge up to 30 days before the start of the rental period.
11.2 For later cancellations, the cancellation conditions as stated in the booking confirmation apply.
12. Liability
12.1 The landlord is fully liable for intent and gross negligence.
12.2 The landlord is not liable for indirect damage, such as lost holiday enjoyment.
12.3 Guests assume full responsibility for any damage, injury or loss that occurs on the premises or in the facilities. The tenant is obliged to report property damage to the landlord immediately.
13. Use of Internet/WLAN
13.1 The landlord provides the guest with access to the Internet via a WiFi network during the rental period. By using the WiFi network, the guest agrees to the following conditions.
13.2 Access is achieved by providing a password, which is made available to the guest after the rental agreement has been concluded. The password must be treated confidentially and may not be passed on to third parties. If the password is misused, the landlord reserves the right to block access without prior notice.
13.3 The guest undertakes to use the WLAN exclusively within the framework of the applicable laws. In particular, the following is prohibited:
Accessing or distributing copyrighted content without permission.
Calling up or disseminating content that is harmful to minors, illegal or punishable.
Harassment, insult or defamation of third parties.
Spreading viruses or other malware.
13.4 The guest is fully liable for damage caused by misuse or illegal use of the WLAN. The guest undertakes to indemnify the landlord from all third-party claims based on unlawful use of the WLAN.
13.5 The landlord logs data necessary for security and to clarify legal violations (such as IP addresses and access times). This data will be used exclusively for this purpose and will be sent no later than [e.g. B. 7 or 30 days] will be deleted unless misuse is detected. In the event of legal violations, the data may be passed on to authorities or affected third parties.
13.6 The landlord does not guarantee the availability, speed or security of the WiFi. Failures that are beyond the landlord’s control do not constitute a claim by the guest.
13.7 The landlord is not responsible for the data transmitted via the WLAN or the guest’s actions carried out via it. If the landlord is legally prosecuted due to the guest’s behavior, the guest undertakes to indemnify the landlord from all costs and claims.
13.8 The landlord reserves the right to block access to the WLAN without prior notice in the event of misuse or suspected legal violations.
14. Data Protection
14.1 The landlord processes personal data in accordance with the GDPR.
14.2 The data is used exclusively for contract fulfillment and communication.
15. Contract term, termination of the rental agreement
The rental agreement ends automatically when the agreed rental period expires.
16. Vacation of the rental property
The tenant must leave the rental property in a proper condition.
17. Force Majeure
In the event of force majeure (e.g. natural disasters, pandemics), both parties can withdraw from the contract. Payments made will be refunded.
18. Applicable Law
German law applies.
19. Alternative Dispute Resolution
The EU platform for online dispute resolution is available at [https://ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr). The landlord is not obliged to take part in a dispute resolution process.
